U POTRAZI ZA PRAVOM MEROM – ZABRANA NEGACIONIZMA U UPOREDNOM EVROPSKOM ZAKONODAVSTVU
Apstrakt
U radu se analizira način na koji države članice EU implementiraju institut zabrane negacionizma u svoja zakonodavstva. Negacionizam je vrlo značajna društvena tema koja se odnosi na javno poricanje, umanjivanje ili odobravanje određenih zločina iz prošlosti. EU je pokušala da harmonizuje različita zakonodavna rešenja usvajanjem Okvirne odluke, koja predviđa standardizovane elemente bića krivičnog dela negacionizma. Osnovna hipoteza je da je širenje pojma negacionizma u Odluci omogućilo dodatnu diferencijaciju zakonodavnih rešenja država članica s obzirom na njihova različita istorijska iskustva. Cilj istraživanja je da ukaže na posledice te diferencijacije. U tu svrhu se koristi uporedni metod analize zakona o negacionizmu država članica i određeni primeri iz prakse. Grupišu se države članice na osnovu zajedničkih karakteristika pristupa zabrani negacionizma. U zaključku se ističu uviđene razlike koje potvrđuju početnu hipotezu.
