Upotreba veštačke inteligencije u advokatskoj profesiji i osiguranje od profesionalne odgovornosti: između tradicionalnog pokrića i novih rizika

Apstrakt

Sve veća upotreba veštačke inteligencije (AI) od strane advokata menja način na koji se pružaju pravne usluge. AI može doprineti povećanju efikasnosti, smanjenju troškova i omogućiti advokatima da brže obrađuju velike količine informacija. Istovremeno, primena AI otvara značajna pravna pitanja, budući da AI sistemi mogu generisati netačne ili izmišljene informacije, što potencijalno može dovesti do odgovornosti advokata i povrede standarda dužne pažnje.

 

Rad je posvećen analizi pitanja da li je šteta nastala upotrebom AI pokrivena osiguranjem od profesionalne odgovornosti, budući da osiguravači još uvek nisu isključili svoju obavezu za rizik povezane sa upotrebom AI, uprkos nedostatku informacija neophodnih za adekvatnu procenu rizika. Autor razmatra da pokriće po osnovu ovog proizvoda osiguranja u najvećoj meri zavisi od toga da li se korišćenje AI alata od strane advokata u konkretnom slučaju može kvalifikovati kao osigurana „profesionalna usluga“ i da li je primena tehnologije bila podvrgnuta odgovarajućem nadzoru. Posledično, osiguravači će sve veću pažnju posvećivati upravljanju rizicima povezanima sa AI, postupcima provere, zaštiti podataka i tehnološkoj osposobljenosti advokata prilikom procene i preuzimanja rizika osiguranja, što potvrđuju i predstavljena uporednopravna rešenja.
