(NE)OPRAVDANOST PRIMENE RADNOPRAVNIH PRAVILA O ZAŠTITI OD OTKAZA NA SAMOZAPOSLENA LICA

Apstrakt

Primena zaštitnih odredaba radnopravnog zakonodavstva na samozaposlena lica predstavlja nedovoljno proučenu oblast radnog prava, te se u radu putem uporednopravnog i normativnog metoda porede prava zaposlenih i samozaposlenih i razlika među njihovim pravnim položajima u pravu Španije, Austrije, Ujedinjenog Kraljevstva Velike Britanije i Severne Irske i Sjedinjenih Američkih Država, sa fokusom na pitanje zaštite od neopravdanog otkaza. Takođe, analizira se postojanje međukategorije ekonomski zavisnih samozaposlenih, te se polazi od hipoteze da samozaposleni koji rade za drugog opravdano nisu obuhvaćeni zaštitom od otkaza poslodavca, za razliku od ekonomski zavisnih samozaposlenih kojima je neopravdano uskraćena ova zaštita, iako kod njih ne postoji disperzija preduzetničkih rizika i šansi.
