Characteristics of Legal Regime of Leasing in Belgium

Abstract

Belgium was among the first European countries who started to develop leasing as a financial method, and the second one in Europe (and in the World as well) who had done the law on financial leasing. Development of financial leasing in Belgium is very closely connected with the legal regime introduced by the Law.

The Belgian law is very similar to French one, besides some questions are more “problematic” (purchase option and its obligatoriety), and some of them are better resolved than the Franch ones (definition of financial leasing transaction). Both French and Belgian laws are regulating the statutory questions concerning the firms engaged in lease financing business.

In this article the author analising the specialties of financial leasing (location-financement) in Belgian law (the original version by 1967 and its modifications introduced 1994. ).
